PRIVACY POLICY
The following Privacy Policy describes the information which Synchrony Telemed LLC. collects, how we use it, and with whom we share it.
1. Information We Collect
Synchrony Telemed LLC. and its affiliate Inovotek Inc., ("HUBCHART™" or "we" or "us" or "our" or other similar pronouns) takes your privacy matters very seriously. Please read the following to learn more about our Privacy Policy ("Policy"). This Policy details how we receive, collect and use information in connection with our website located at www.hubchart.io (the "Site"), the Hubchart™ mobile software application ("Hubchart™ App" or the "App"), and other products and services provided on the www.hubchart.io website (all of the foregoing, collectively, the "Service").
By using the App or visiting this Site or using the Service, you are accepting the policies and practices described in this Policy, as such Policy may be amended from time to time. Each time you visit the Site or use the Service, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Policy.
To be clear about the terminology we are using, when we use the phrase "Personal Information" in this Policy, we mean information about you that is personally identifiable, like your name, address, e‐mail address, billing information, or phone number, as well as other non‐public information that is associated with this personal information. When we use the phrase "Anonymous Information" in this Policy, we mean information that is not personally identifiable, or linked to your Personal Information such as aggregated information, general demographic information and IP addresses. Anonymous Information does not necessarily enable identification of individual persons.
IF YOU ARE A USER ACCESSING THE SITE OR SERVICE FROM THE EUROPEAN UNION, ASIA, OR ANY OTHER REGION WITH LAWS OR REGULATIONS GOVERNING PERSONAL DATA COLLECTION, USE, AND DISCLOSURE THAT DIFFER FROM UNITED STATES LAWS, PLEASE BE ADVISED THAT THROUGH YOUR CONTINUED USE OF THE SITE AND SERVICE, WHICH ARE GOVERNED BY UNITED STATES LAW, THIS PRIVACY POLICY, AND OUR END USER LICENSE AGREEMENT, YOU MAY BE TRANSMITTING YOUR PERSONAL INFORMATION TO COUNTRIES (INCLUDING THE UNITED STATES) WHERE LAWS REGARDING PROCESSING PERSONAL INFORMATION MAY BE LESS STRINGENT THAN THE PROCESSING OF PERSONAL INFORMATION IN YOUR COUNTRY AND YOU HEREBY CONSENT TO SUCH TRANSMISSION OF PERSONAL INFORMATION.
2. How We Use Your Information
When you install the App or use its Website www.hubchart.io or the Service, Synchrony Telemed Inc. and its affiliate Inovotek Inc. may collect information about you, including but not limited to, your name, phone number, email address, physical address and other information about you. Synchrony Telemed Inc. and its affiliate Inovotek Inc. may also collect information when your web browser accesses our Website, including the internet protocol (IP) address of your computer, geographic location as determined by your IP address, your browser software and operating system, your web server, the date and time you access our site, session information (such as download errors and page response times), information about your viewing and search history, and information about the referring URL and the URL clickstream to, through and from our Websites. We may gather this information in various ways, including but not limited to, through the use of “cookies.” A “cookie” is a piece of information that Synchrony Telemed Inc. and its affiliate Inovotek Inc. sends to your browser, which then stores this information on the hard drive of your computer and when using the Hubchart™ App.
Synchrony Telemed Inc. and its affiliate Inovotek Inc. may use your information for the following purposes:
You will be asked to provide us with your phone number, email, name, photo, and other personal information (phone number and email is mandatory and the rest is optional) and to allow us access to your mobile device's address book.
A copy of the phone numbers and names in your address book (but not emails, notes or any other Personal Information in your address book) will be stored on our servers. Further, with the App, you will be asked to provide your phone number, name, location and other information to help other users verify your contact request or invite request. These information will be used to:
(a) Notify you when your contacts become active on Hubchart™
(b) Indicate which of your contacts is already a Hubchart™ user,
(c) Display the name of each contact as it appears in your address book when a message is received.
(d) Sync your contacts with Hubchart™ running on iOS, Android, OS X, Windows, Linux or other Operating system that can run a web browser.
The copy of your address book (names and phones) is stored on a live database. This database does not have a "historical backup". If you delete the address book from our servers, it will be deleted instantly and permanently.
Your phone number and email will be used for identification purposes as your Hubchart™ user ID.
Since Hubchart™ users may add your Hubchart™ number to their address book and see that you registered to Hubchart™, we do not consider the fact that your Hubchart™ number exists on Hubchart™ as private information.
Name, Photo and other information
Should you provide your name and/or photo it will be visible to other Hubchart™ users as long as:
a. Such users have your Hubchart™ number, or
b. All of you participate in the same Group (or Chat group)
c. Online Status and Seen Status
Other users will see your connection status (whether you are online or not – and if not, when was the last time you were connected to the service) as well as whether you saw messages they sent to you.
Location Information
Hubchart™ allows you to provide your location information in your profile or to messages you send to other users or send a specific location message. If you choose to share your location with a specific user or group of users your location will be retrieved from your device and sent to Hubchart™. Hubchart™ does not use your location for any other purpose other than storing it for other users to see and help identify you to other users. This information is optional in the profile section and you can opt not to provide it.
Other Services
In the event we make message boards, group chats or Forums available to you (collectively referred to as 'Forums'), you will be solely responsible for the information and any other content you post on and through these Forums and should be aware that when you voluntarily disclose Personal Information (e.g., name, e‐mail address, telephone number) on or through these Forums, such information is generally accessible to, and may be collected and used by, other users. This may result in unsolicited messages from third parties, and such messages are beyond our control. We do not exercise control over any users or Site visitors, and in no way are we responsible, nor do we have any liability whatsoever, for any collection or use of information you may disclose through the Forums. This Policy does not cover such disclosure of information. You are encouraged to exercise discretion when providing personal information about yourself in and through Forums. Please do not post any Personal Information on this Site that you expect to keep private.
Passwords
You will be asked to supply a Hubchart™ password, which only you the user knows. It is the sole responsibility of the user to supply a strong password and to keep best practices in keeping the password safe and secured. Passwords are encrypted before it is saved on our servers, no employees of Synchrony Telemed Inc. and its affiliate Inovotek Inc. have access to the users password in unencrypted form.
Messages
Hubchart™ is a messaging app and messages are shared by users to other users they interact with such as joining a group chat or individual chats. The user has sole responsibility about the content posted. Group messages are not moderated and therefore users should be aware that content posted by users is their own sole responsibility. Hubchart™ takes no responsibility or liability from any damages caused by a user message posts.
Message History
Messages are kept in our servers for one year after which it is automatically deleted. Hubchart™ does not take any responsibility from lost of data as such. Hubchart™ uses industry standard encryption for the messages stored in your device, during transit and at its backend server. Hubchart™ secures the messages on a 'best efforts' basis using industry best practices and industry standard encryption. Further, Hubchart™ tries on a 'best effort' basis to de‐personalize the data when stored such that any information is non‐identifiable to person, however Hubchart™ does not ensure messages may be compromised in an event of a highly sophisticated hacker attack (cyber attack).
Hubchart App provides the user app security tools to lock their devices via a 4 digit PIN or by touch ID for touch ID enabled device. It is the sole responsibility of the user to keep the app secured in their devices by using the app security tools provided. In the event of a phone theft or if the device falls in the hands of un‐authorized person, it is the responsibility of the user to protect the data by enabling the app security tools provided. Users have the option to inform Hubchart support via support@hubchart.com to temporarily lock the device should the device fall into the hands of an un‐authorized person. It is responsibility of the user to inform Hubchart support of such an event. Hubchart will lock out a device provided the user is able to answer the appropriate security questions. It is also the responsibility of the user to keep their email (registered in Hubchart) secured as password resets are sent thru this email.
Security
We take reasonable precaution to protect Personal Information from misuse, loss and unauthorized access. Although we cannot guarantee that Personal Information will not be subject to unauthorized access, we have physical, electronic, and procedural safeguards in place to protect Personal Information. Personal Information is stored on our servers and protected by secured networks to which access is limited to a few authorized employees and personnel. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure.
3. Compliance with Law
Synchrony Telemed Inc. and its affiliate Inovotek Inc. reserves the right to disclose your personal identifiable information as required by law, when we believe disclosure is necessary to comply with a judicial proceeding, court order or legal process served upon us, and when necessary to enforce or apply the Terms and Conditions for the use of our Website. Additionally, we may disclose your Personal Information if we believe such action is necessary to:
(a) comply with the law, or legal process served on us;
(b) Protect and defend our rights or property (including the enforcement of our agreements); or
(c) Act in urgent circumstances to protect the personal safety of users of our Service or members of the public.
4.Third Parties
In order to provide you with Hubchart™ products you have requested, Hubchart™ may sometimes, if necessary, share your Personal Information (excluding your address book and related information) and traffic data with trusted partner service providers and/or agents, for example: banking organizations or other providers of payment and analytical services, customer support, online presence service, SMS messaging service or hosting services. Hubchart™ will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation. Hubchart™ will never share your address book information with any third party, except as may be required by law (see below).
The following is a description of how we may share your Personal Information with trusted third party partners. Should we add additional partners, we will immediately update this description:
1. We use third party companies in order to send you an authentication SMS when you register with Hubchart™. In order to send you the SMS, we send one of these third party companies your phone number and the authentication message. These third parties are contractually obligated to only use your phone number for the transmission of the authentication SMS.
2. If we fail to send you an SMS (this happens in certain cases) you may ask us to call you and read you the authentication code on the phone. This is done using a third party automated phone system. In order to call you, we provide this third party partner with your phone number and send the "audio content" of the call to them. The third party partner in turn will typically use another phone provider who may use another phone provider and so on until the call reaches you. This is an industry standard mechanism for the transmission of phone calls. The third party partner is contractually obligated to only use your phone number for the completion of the authentication phone call.
3. We may use Push Notification Services to notify you about various events related to the app. If we do, the phone number or the name of the person calling you or sending you a message may be part of the notification. This message is sent to the push notification service provider, for delivery to your device.
We may disclose information about you if we determine that for national security, law enforcement, or other issues of public importance that disclosure of information is necessary.
We may from time to time ask you to provide information about your experiences, which will be used to measure and improve quality. You are at no time under any obligation to provide any of such data. Any and all information which is voluntarily submitted in feedback forms on the Site or any survey that you accept to take part in is used for the purposes of reviewing this feedback and improving the Hubchart™ software, products and websites.
We may contact you to send you messages about faults and service issues. Furthermore, we reserve the right to use email, the Hubchart™ software or SMS to notify you of any eventual claims related to your use of our software, websites and/or products, including without limitation claims of violation of third party rights.
We may send you alerts via the Hubchart™ software to notify you when someone has tried to contact you. We may also use the Hubchart™ software to keep you up to date with news about our software and products that you have purchased and/or to inform you about other Hubchart™ products and related information.
5. Children's Privacy
Hubchart™ websites and software clients are not intended for or designed to attract anyone under the age of 13 and we do not intentionally or knowingly collect Personal Information on our sites from anyone under the age of 13 (or older in some jurisdictions). We encourage parents to be involved in the online activities of their children to ensure that no information is collected from a child without parental permission.
6. Business Transitions
In the event that we go through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of our assets, Personal Information will likely be among the assets transferred. As part of such a transaction the new entity will be required to commit to the same level of protection of your Personal Information as described in this Privacy Policy. If we cannot obtain such a commitment, we will not perform the business transition.
We will post a notice on this Site of any such change in ownership or control of the Personal Information we may have prior to such transfer.
7. Changes to Policy
From time to time, we may revise this Policy. We reserve the right to update or modify this Policy, or any other of our policies or practices, at any time with or without notice. However, we will not use your Personal Information in a way that is materially different than the uses described in this Policy without giving you an opportunity to opt‐out of such differing uses. We will post the revised Policy on the Site, so that users can always be aware of what information we collect, how the information is used and under what circumstances such information may be disclosed. You agree to review the Policy periodically so that you are aware of any modifications. Your continued use of the Site indicates your assent to any changes and signifies your agreement to the terms of our Policy. If you do not agree with these terms, you should not use the Site, the Hubchart™ App, or any other Service.
8. Change or Removal of Information
If you provided your e‐mail address to us and wish to update it, you may do so by sending an e‐mail to support@hubchart.com.
If you no longer wish to receive e‐mail communication from us, such as offers, updates and newsletters, you may opt‐out of receiving such communications by following the instructions included in each newsletter or communication. In addition, you can remove your e‐mail address at any time by sending an e‐mail with the subject line of UNSUBSCRIBE to unsubscribe@hubchart.com.
Due to technological reasons, we do not know when and if you delete the application. Therefore, if we detect no activity from your device for 90 days, we will assume that you deleted the application and we will remove your address book from our servers. However, since we are not certain that you deleted the application (you may just be on vacation, etc.) we will not deactivate your Hubchart™ account (which is your phone number and device ID). We do not want to force you to register again in the event of non‐use.
If you wish to delete your account completely, you can go to the "More" tab in the Hubchart™ App, and tap the "Deactivate Account" option. Please note that this will remove your data from Hubchart™, and deactivate Hubchart™ on your device. If you have additional concerns and/or requests, you can contact Hubchart™ at support@hubchart.com.
